In the matter of Prendergast and Garine (Dail Voting)
This Court notices the statement of the plaintiff in this cause that he was not bringing a case against the respondent;
that the action complained of, the practice of absolute majority voting in the Dail in place of the normal plurality system, has been discontinued,
that the respondent has apologised for this error,
This Court finds that;
the case lapses by mutual consent.
However the Court rules upon application by the plaintiff that nowhere in the Constitution of the Republic or the Procedural Rules of the Dail is there a requirement of absolute majority voting for parliamentary purposes. A simple majority is sufficient for passing of ordinary bills. Constitutional amendments are dealt with by appropriate provisions in the Constitution.
