Criminal Code for our Republic
Gentlemen,

Edgard Portela has very correctly pointed out that our country is lackign in any formal criminal code. Whilst our Constitution lays a foundation for the establisment and running of the Judiciary, it holds no information of crimes and punishment et cetera.

I ask, is there anyone willing to construct such a thing? Additionally is it worth contacting Gotzborg so that we can swear in a judge and have them preside over the discussions?

Hmmm, maybe Gotzborg could send one of their Law School graduates over to help.

I'm not sure which micronations have working criminal codes, I know Babhka has one that was pretty controversial when it passed. We need to make sure that we have a criminal code that is a.) fair, b.) comprehensive enough to be applied in a micronation and c.)clear, concise and easy to read.

Definately. I have put to the Dáil an ammenment that formally allows us to act upon our treaty with Gotzborg and request an impartial judge. When that is passed - hopefully soon - we can get the ball rolling big style.

Awesome. Now, what can we do in the meantime is at least draft an outline of what a code would look like...

Crimes Against Republic: Assassination, Bribery of Republic's Officials, Contempt, Counterfeiting/Forgery, Embezzlement of Funds, Greater Treason, Lesser Treason, Rebellion, Sabotage.

Crimes Against the Public: Breach of the Peace, Collusion, Fraud, Mayhem and Riot

Crimes Against Persons and Organizations: Abandonment, Arson, Assault and Battery, Blackmail, Burglary, Embezzlement, Forgery, Homicide, Kidnaping, Larceny, Libel, Manslaughter, Slander and Trespassing.

Crimes Against Justice: Barratry, Contempt of Court, Judicial Blackmail, Judicial Bribery and Perjury

Criminal Code of Canada - pretty extensive and huge... but it's good for looking at how criminal codes are set up and such.

Model Criminal Code - by Attorney General of Australia - all in PDF files... I'm not sure about how useful this one can be, I didn't look all the way through it because it was much too PDF viewing...

Wikipedia article on "Criminal Code" - with links to macronational criminal codes... the article is a stub, however.

I think that along with the drafting and instatement of a criminal code, we should launch a process of codifying all of our laws as well.

That treaty passed already Statute Book.

Its just a matter of that ammendment going through before we can make the most of it.

I'll enter into formal dialogue with ACII as soon as I get a few spare minutes, and get a list of people His Majesty considers suitable candidates, before getting in touch with them. Better do follow this path, I think, than to do what I did for the EC and advertise in their open forum.

Particularly considering what happened last time somebody tried to do that... ;-)
